Interior Dept. Proposes to Streamline the ESA - [ 9/23/2008 ]

On August 15, 2008, the U.S. Department of Interior published a notice of proposed rulemaking to amend its existing regulations implementing the consultation process under Section 7 of the Endangered Species Act (ESA).
To comply with the ESA, federal agencies and private entities seeking to obtain a development permit must consult with the Fish and Wildlife Service and National Marine Fisheries Service to determine the impact of the development on any endangered species. The primary purposes of this proposed rule are to clarify when federal agencies are required to consult with the Fisheries Services, provide better guidance on the effects of the federal agency action that must be reviewed, and streamline the informal consultation process.
Comments on the proposed rules are to be submitted to the U.S. Fish and Wildlife Service in September. |
